Have you been injured, but are reluctant to talk with a personal injury lawyer because you think it might be too expensive? Hiring a personal injury lawyer is usually much less expensive than hiring other types of lawyers. Here are some tips for you to keep in mind as you talk to and work with personal injury lawyers.

Consultations should be free. Personal injury lawyers should not charge you to talk about your case. You can the accident and discuss the general details of your case. At this point you can also have the attorney give you an idea of what they think your case is likely to be worth in compensatory and other possible damages. The accident attorney should also be able to give you some idea of how long it should take to get results. Many personal injury cases are taken "On Contingency".

Personal injury lawyers will often take your case on a "contingency fee basis." This means that you are not required to pay any attorney's fees until you recover compensation from the party at fault or their insurer. If there's no compensation in your case, you do not owe any attorney's fees. If you do reach a settlement, a portion of that settlement will go to your lawyer for his or her fees. Contingency percentages vary greatly and can change from one location to another location. Not every accident lawyer or law firm chares the same amount so shopping around can be in your best interest. The percentage can also change from case to case. Perceived risk in regards to collections can also influence the percentage that a personal lawyer charges.

If you are unable to find a personal injury lawyer to take your case on a contingency fee basis, some personal injury lawyers will charge you hourly to be paid monthly or on some other agreed to interval. In this case, the personal injury lawyer would get paid whether or not you end up receiving any compensation. An important thing to note here is that if you are unable to find a personal accident attorney to take your case on contingency, you either have not been adequately utilizing your legal resources or you do not have a very good case.

Regardless of how the legal fees are structure, there are expenses that are incurred in handling a case which will have to be paid. Personal injury lawyers generally pay the costs associated with putting your case together. These costs include but are not limited to:

  • Court filing fees
  • Expert witness fees
  • Copies of police reports
  • Office expenses such as copying
  • Medical records
  • Investigator charges

The personal injury lawyer pays these expenses as needed, after which you reimburse the lawyer for expenses out of your settlement. If your personal injury lawyer is willing to provide the necessary funds to keep your case moving forward, it is a good sign. After all, the lawyer is taking a gamble by doing so because if you donít receive a settlement they will not likely be reimbursed for those fees and they will be out that money. Their willingness to provide these funds towards you case is a good indicator that they believe that you have a reasonably strong case.

It is always important to have a prearranged agreement as to how and when these fees will be paid or repaid. Most often, a lawyer's contingency fee will be based on the gross settlement amount, prior to costs being subtracted.

Some states consider it unethical for a lawyer to advance you the costs of your medical care but good personal injury lawyers may be able to assist you with obtaining loans if you do not have any other means with which to pay your medical expenses.
